Terms of Service
Last Updated: September 23, 2026 • Effective Immediately
Welcome to Firetalk! These Terms of Service (the "Terms" or "Agreement") constitute a legally binding agreement between you (whether individually or on behalf of an entity) and Firetalk ("Firetalk", "we", "us", or "our"), governing your access to and use of the Firetalk web platform (https://firetalk.net), desktop client applications (Windows and macOS), mobile applications (iOS and Android), voice and video communication servers, short-form video feeds ("Reels"), and all associated software and digital services (collectively, the "Services").
1. Acceptance of Terms & Eligibility
By creating an account, downloading or installing the client software, participating in any voice or video room, purchasing Virtual Credits or subscriptions, or otherwise accessing the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our companion Privacy Policy and Refund Policy. If you do not agree to all provisions of these Terms, you are strictly prohibited from accessing or using the Services and must immediately cease use and uninstall all software.
Age Requirement: You must be at least thirteen (13) years of age to register for a basic account. If you reside in a jurisdiction where the age of digital consent is higher (e.g., 16 in certain European Economic Area jurisdictions), you must meet that threshold. Access to Restricted (R-Rated) rooms, financial transactions, creator earnings, and payout withdrawals strictly requires you to be at least eighteen (18) years of age (or the age of legal majority in your territory). Any account discovered to have been registered by a minor misrepresenting their age will be terminated immediately.
2. Accounts, Registration & Nicknames
To access the full functionality of Firetalk, you must register by providing a valid email address and choosing a unique alphanumeric nickname ("Username").
- Accurate Information: You agree to provide true, current, and complete registration information and to keep your credentials updated.
- Credential Security: You are solely responsible for maintaining the confidentiality of your password, authentication tokens, and account access. You are strictly responsible for all transmissions, chat activity, room management, and monetary transactions executed through your credentials.
- Nickname Proprietary Rights: You may not select a nickname that infringes upon any third-party copyright, trademark, or intellectual property right, nor one that impersonates another individual, public figure, or Firetalk official, administrator, or moderation staff member. Firetalk reserves the sole authority to rename, suspend, or revoke any nickname deemed defamatory, deceptive, vulgar, or in violation of our standards.
- Account Inactivity: In order to maintain efficient system performance and recycle dormant identifiers, Firetalk reserves the right to deactivate accounts that remain continuously inactive (without any login) for more than one hundred and eighty (180) calendar days.
3. Room Ratings & Zero-Tolerance Anti-Pornography Policy
Firetalk provides real-time community chat rooms categorized into clear classifications to foster constructive public and private discourse:
- General (G-Rated) Rooms: Family-friendly, open community rooms dedicated to music, gaming, technology, educational dialogue, and social mingling. In G-Rated rooms, profanity, vulgar language, crude sexual innuendo, and mature discussions are strictly forbidden.
- Restricted (R-Rated) Rooms: Designed exclusively for verified adults aged 18 and older. R-Rated rooms allow adult members to engage in unfiltered political debate, mature philosophical discussion, and adult language.
Unlike historical legacy chat networks, Firetalk does NOT host, allow, or tolerate adult pornographic or sexually explicit rooms ("A-Rated Rooms") under any circumstances. Broadcasting, transmitting, streaming, publishing, or sharing any of the following on Firetalk constitutes an immediate, non-negotiable ground for permanent ban, account forfeiture, and permanent hardware and IP blacklisting:
- Nudity, exposed genitalia, buttocks, or female breasts.
- Live or recorded sexual acts, masturbation, or sexually explicit behavior.
- Commercial solicitation of prostitution, escort services, or cam-model pornography.
- Any depiction of child sexual abuse material (CSAM) or exploitation of minors, which is reported immediately to the National Center for Missing and Exploited Children (NCMEC) and international law enforcement authorities.
4. Regional Geographic Access & Compliance (Middle East / GCC)
Firetalk respects and enforces the national legal frameworks, cultural norms, and telecommunications regulations of the countries in which our users reside:
- Geographic Filtering: In compliance with telecommunications standards and legal statutes in specific sovereign territories—including the Kingdom of Saudi Arabia (Communications, Space & Technology Commission - CST), the United Arab Emirates (Telecommunications and Digital Government Regulatory Authority - TDRA), and other Gulf Cooperation Council (GCC) member states—access to R-Rated rooms is automatically restricted and disabled for users originating from, or registered within, these designated jurisdictions.
- Prohibition of Circumvention: Users agree not to utilize unauthorized Virtual Private Networks (VPNs), proxies, Tor routing, or spoofing mechanisms to deliberately bypass territorial content filters. Any verified circumvention of regional compliance filters constitutes a material breach of this Agreement and may result in immediate suspension.
5. Video Reels, Stories & User-Generated Media
Firetalk includes public short-form media feeds ("Reels") and user stories allowing members to broadcast creative content, audio sound clips, and video highlights.
- Creator Ownership: You retain your underlying intellectual property rights in the original photos, audio clips, and videos you submit to Firetalk.
- Global Platform License: By publishing User Submissions (including Reels, stories, room recordings, or profile media) to public areas of Firetalk, you grant Firetalk a worldwide, non-exclusive, royalty-free, transferable, and sublicensable license to host, transcode, cache, distribute, publicly display, and stream your submission in connection with platform operations, directory listings, and service promotions.
- Content Representations: You represent and warrant that you possess all necessary copyrights, synchronization licenses, trademark permissions, and privacy releases for all individuals depicted in your media before uploading.
- Synthetic & AI-Generated Media: You may not upload deepfakes, non-consensual synthetic depictions of real persons, misleading AI propaganda, or automated spam into the Reels feed or community rooms.
6. Real-Money Credits, Memberships & Merchant of Record
Firetalk incorporates a robust digital economy enabling members to enhance their community standing, customize room features, and support their favorite broadcasters.
- Firetalk Credits: Credits are monetary digital currency units purchased on Firetalk. Credits can be sent as animated virtual gifts, celebratory stickers, and tips to broadcasters in voice and video rooms.
- Nickname Subscriptions: Personal account upgrades (Plus, Extreme, VIP, and Prime) provide colored nicknames, HD camera broadcasts, multi-room attendance, and priority recognition. Subscriptions are billed on a recurring monthly or annual basis as selected upon checkout.
- Room Subscriptions: Voice and video room host upgrades (Deluxe Room, Extreme Room, and Elite Room) provide expanded room capacity (up to unlimited), up to six (6) simultaneous broadcast microphones, custom room title colors (Blue, Green, Purple), and priority directory ranking.
- Merchant of Record Disclosure: All inbound purchases on Firetalk are processed securely through certified Merchant of Record (MoR) and payment gateway partners, primarily Paddle (Paddle.com Inc. / Paddle Payments Ltd.) and PayPal. Our Merchant of Record is legally responsible for customer order handling, currency exchange, sales tax, value-added tax (VAT), and payment receipts.
- Auto-Renewal & Cancellation: Recurring subscriptions automatically renew at the end of each billing cycle unless canceled prior to the renewal date via your Account Settings or customer billing portal. Cancellations take effect at the conclusion of the paid term.
7. Creator Economy, Revenue Share & Cashout Withdrawals
Unlike platforms that utilize purely ornamental play tokens, Firetalk credits represent real monetary value circulating through a genuine Creator Economy:
- Broadcaster Earnings: When viewers tip or send animated gifts to a broadcaster or host in a voice/video room using purchased credits, the platform automatically credits the broadcaster's account with real-money creator earnings pursuant to the prevailing platform revenue-share schedule (e.g., 50% creator share or as configured in platform terms).
- Settlement & Vesting: Gifted credits undergo a standard security settlement period (typically fourteen (14) calendar days) to protect against credit card fraud, stolen funds, and chargebacks before moving from pending balance to withdrawable balance.
- Withdrawals & Minimum Threshold: Broadcasters whose available balance satisfies the minimum withdrawal threshold (e.g., $50.00 USD) may submit an official cashout withdrawal request to their designated PayPal account or verified banking channel.
- Anti-Money Laundering (AML) & KYC: To comply with international financial crime statutes, Bank Secrecy Act guidelines, and FATF recommendations, Firetalk reserves the right to require valid government-issued photographic identification, tax documentation (e.g., W-9 or W-8BEN), and residential verification before processing high-volume payouts.
- Forfeiture for Fraudulent Activity: Accounts engaged in credit laundering, self-tipping with stolen payment credentials, collusive manipulation of ranking leaderboards, or chargeback scams will suffer immediate termination, irreversible balance forfeiture, and potential civil and criminal referral.
8. Community Code of Conduct & Prohibited Acts
You agree to maintain a safe, welcoming, and civil environment for all users. You shall not engage in, encourage, or assist in any of the following prohibited behaviors:
- Harassment & Bullying: Stalking, threatening, doxxing, intimidating, or maliciously targeting community members or staff.
- Hate Speech: Promoting violence, discrimination, or derogatory attacks based on race, ethnicity, nationality, religion, disability, gender, or sexual orientation.
- Terrorism & Violent Extremism: Advocating terrorist organizations, illicit paramilitary militias, or acts of violent extremism.
- Commercial Spam & Phishing: Distributing unsolicited marketing spam, referral links, phishing URLs, credential-stealing trojans, or malware.
- Reverse Engineering & System Tampering: Attempting to decompile, reverse-engineer, exploit memory bugs, scrape private APIs, or launch Denial-of-Service (DoS/DDoS) attacks against Firetalk infrastructure.
9. Intellectual Property & Copyright Infringement (DMCA)
Firetalk respects the intellectual property rights of artists, publishers, and content creators. Pursuant to the Digital Millennium Copyright Act (17 U.S.C. § 512), copyright owners or authorized agents may submit takedown notifications for infringing materials hosted on the Services.
Written notices must be submitted to our designated Copyright Agent and include:
- Physical or electronic signature of the authorized copyright holder.
- Specific identification of the copyrighted work claimed to have been infringed.
- The exact URL, room identifier, or link sufficient to permit us to locate the infringing material.
- Your contact information (name, address, telephone number, and email).
- A statement of good faith belief that the contested use is unauthorized by the copyright owner, its agent, or the law.
- A statement under penalty of perjury that the information in the notification is accurate and that you are authorized to act.

10. Room Moderation, Host Powers & Administration
Room owners and designated administrators hold significant authority to maintain order within their hosted rooms:
- Moderation Tools: Room hosts have access to native tools to grant or revoke broadcast microphone access ("Take Mic" / "Release Mic"), eject disruptive participants ("Bounce"), and permanently ban unruly users from their specific room list.
- Platform Super-Moderation: Firetalk official administrative personnel maintain super-moderator capabilities across all public and restricted channels to enforce these Terms, protect user safety, and respond to platform emergencies.
11. IP Logging, Session Monitoring & Abuse Prevention
To maintain platform integrity, detect malicious multi-accounting, prevent payment fraud, and assist authorized cybercrime investigations, Firetalk's backend infrastructure automatically records and maintains technical logs:
- Technical Data Logged: Remote IP addresses, session duration, geographic connection location, hardware identifiers, WebRTC connection performance metrics, and administrative action logs.
- Blacklisting: Verified abusers, spammers, and fraudulent operators are subject to automated IP subnet and device fingerprint blacklisting across the entire platform.
12. Suspension, Deactivation & Account Termination
Firetalk reserves the right, in its sole and unfettered discretion, to issue warnings, temporarily suspend features, or permanently terminate any account that violates this Agreement, without prior notice. In the event of account termination resulting from code of conduct violations, fraudulent chargebacks, or illegal broadcasts, all accumulated credits, active subscription periods, and pending creator earnings shall be deemed forfeited without liability or refund.
13. Disclaimers, Limitation of Liability & Dispute Resolution
"AS IS" Warranty Disclaimer: THE SERVICES AND SOFTWARE ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, FIRETALK DISCLAIMS ALL WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Limitation of Liability: IN NO EVENT SHALL FIRETALK, ITS DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, OR PAYMENT PARTNERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICES.
Binding Arbitration: Any dispute, controversy, or claim arising out of or relating to these Terms or the breach thereof shall be settled by binding confidential arbitration administered in accordance with established commercial arbitration rules. You agree that all claims must be brought in your individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding.
